Welcome to VixHQ. These Terms and Conditions ("Terms") govern your use of the VixHQ mobile application (the "App") and the website located at VixHQ.com (the "Site"), collectively referred to as the "Service." The Service is owned and operated by VixHQ ("we," "us," or "our").

By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must immediately cease use of the Service and delete the App from your device.

2. Apple App Store Specific Terms (Required for Approval)

You and VixHQ acknowledge that:

Acknowledgement: This agreement is between you and VixHQ only, not Apple, Inc. VixHQ is solely responsible for the App and its content.

Scope of License: The license granted to you is a non-transferable license to use the App on any Apple-branded products that you own or control as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

Maintenance and Support: VixHQ is solely responsible for providing maintenance and support services. Apple has no obligation whatsoever to furnish any maintenance or support services for the App.

Warranty: VixHQ is solely responsible for any product warranties. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever.

Product Claims: VixHQ, not Apple, is responsible for addressing any claims related to the App, including product liability, legal/regulatory compliance, or consumer protection.

Intellectual Property Rights: In the event of a third-party claim that the App infringes intellectual property rights, VixHQ, not Apple, will be responsible for the investigation and defense of such claim.

Third-Party Beneficiary: You acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you.

3. Eligibility and Legal Compliance

By using VixHQ, you represent and warrant that:

You are at least 18 years of age (or the age of majority in your jurisdiction).

You are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country.

You are not listed on any U.S. Government list of prohibited or restricted parties.

4. User Accounts and Conduct

To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your credentials. You agree not to:

Use the Service for any illegal or unauthorized purpose.

Attempt to decompile, reverse engineer, or hack the Service.

Post or transmit content that is defamatory, obscene, or infringes on others' rights.

Create multiple accounts for deceptive purposes.

5. Intellectual Property

All content, features, and functionality (including text, graphics, logos, and code) are the exclusive property of VixHQ and its licensors. You are granted a limited, revocable license to use the Service for personal, non-commercial use only.

6. User-Generated Content (UGC)

If the Service allows you to post content, you retain ownership of that content but grant VixHQ a worldwide, perpetual, royalty-free license to use, reproduce, and display such content. VixHQ reserves the right to remove any content that violates these Terms or is deemed inappropriate at our sole discretion.

VixHQ reserves the right to modify these Terms at any time.

Notice: We will provide notice of "material" changes by posting the new Terms on the App/Site and updating the "Last Updated" date. We may also send an email or in-app notification.

8. Limitation of Liability and Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, VixHQ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. VixHQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

9. Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or VixHQ.
